Article 1 Definition of Terms

Paragraph 1 Application of Terms

City Cab Co., Ltd. (hereinafter referred to as "the Company") provides hire car services (hereinafter referred to as "the Service") to customers (hereinafter referred to as "Passenger") in accordance with these Transportation Terms (hereinafter referred to as "these Terms").

Passengers who use the Service must agree to these Terms, and by using the Service, they are deemed to have agreed to these Terms.

Paragraph 2 Matters not stipulated in these Terms

Matters not stipulated in these Terms shall be governed by law or general practice.

Section 3: Revisions

We may change these terms and conditions without prior notice or consent from passengers.

Section 4: Measures in Case of Violation of These Terms and Conditions, etc.

Passengers who engage in acts that we deem inappropriate (behaviors listed below) may be denied use of this service.

1. Behaviors that cause inconvenience or disadvantage to third parties.

2. Behaviors that may interfere with our services.

3. Behaviors that soil or damage the interior of the vehicle.

4. Use or possession of illegal drugs (if illegal drugs are used or possessed, the police will be notified immediately)

5. Any other acts that violate these terms

Section 5 Special Provisions

If the Company enters into a special agreement with respect to any provision of these terms and conditions to the extent that it does not violate the spirit of these terms and conditions or the law, the special agreement will apply regardless of the provisions of the relevant provision.

Article 2 Instructions of staff

Section 1 Passengers must follow the instructions given by the Company's drivers and other staff in the course of their duties to ensure the safety of transportation.

Article 3 Acceptance of transportation

Paragraph 1: Our company will accept the transportation of passengers, except in cases where we refuse to accept or continue the transportation pursuant to the provisions of the following article or Article 4, Paragraph 1.

Paragraph 2: Application for transportation

When receiving the provision of this service, passengers can apply for transportation by agreeing to the price list and other items separately specified in this agreement, and by a method separately specified, clearly indicating the type of vehicle, purpose, start date and time of operation, boarding and disembarking locations, whether optional services are required, and other terms of use.

Paragraph 3: Changes to transportation contents

If a passenger wishes to change the terms of use in the previous paragraph, he/she must obtain the consent of our company in advance.

Clause 4 Cancellation of transportation

1. Passengers may cancel reservations (hereinafter referred to as "cancellation") by a method separately specified.

If the passenger is unable to contact us on the reserved day of operation due to his/her own circumstances, or if the contract cannot be concluded, the reservation will be considered canceled.

2. If the passenger cancels the reservation due to his/her own circumstances, the passenger shall pay the cancellation fee set forth below to our company.

Until 6:00 p.m. on the day before the reserved use date: Free

From 6:00 p.m. to midnight on the day before the reserved use date: 50% of the usage fee

From the day of use onwards: 100% of the usage fee

However, the above does not apply if there are separate cancellation regulations for transportation specified by agreement between our company and the passenger.

Article 4 Refusal to accept or continue transportation. Suspension or interruption of transportation

Paragraph 1 Our company may refuse to accept or continue transportation

in any of the following cases.

1. When the application for transportation is not in accordance with these transportation conditions.

2. When there are no facilities suitable for the transportation.

3. When a passenger requests a special burden for the transportation.

4. When the transportation is contrary to the provisions of laws and regulations or public order or good morals.

5. When there is a transportation impediment due to a natural disaster or other unavoidable reasons.

6. When a passenger does not comply with the measures taken by the driver in accordance with the provisions of the Transportation Regulations for Passenger Car Transportation Business.

7. When a passenger is carrying an item prohibited by the Transportation Regulations for Passenger Car Transportation Business.

8. When a passenger is so drunk that he or she cannot clearly state his or her destination or has difficulty walking without assistance.

9. When a passenger is wearing dirty clothes that may contaminate the interior of the vehicle.

10. When a passenger is seriously ill and not accompanied by an attendant.

11. When a passenger is a patient (including a person considered to be a patient) of a Class 1 infectious disease, a Class 2 infectious disease, a new influenza or other infectious disease, or a designated infectious disease (limited to those requiring hospitalization) under the Law on Prevention of Infectious Diseases and Medical Care for Patients with Infectious Diseases, or a person with symptoms of a new infectious disease.

12. When symptoms of intoxication due to narcotics, stimulants, paint thinner, etc. can be confirmed.

13. When a child under the age of 6 is riding in the car despite not applying for or bringing a child seat.

14. When there is a risk of causing inconvenience or disadvantage to a third party.

15. When there is a risk of causing interference with this service.

16. When a person is deemed to be a member or related party of a gang, a gang-related organization, or to belong to any other antisocial organization.

17. When, in the judgment of our standards, it is deemed to have a negative impact on our company or other customers.

Paragraph 2: Suspension and interruption of transportation

Our company may suspend or interrupt all or part of the operation of this service without obtaining permission from the passenger for the following reasons.

When the service cannot be provided normally due to reasons not attributable to the service provider, such as earthquakes, floods, tsunamis, fires, power outages, or other natural disasters.

When the service provider otherwise determines that it is necessary to suspend or interrupt the operation of this service.

Clause 3: Termination of transportation due to inability to use

If the vehicle becomes unusable during the period of use due to an accident, natural disaster, or other reason, the contract shall be terminated.

Clause 4: Cancellation of transportation

1. If the passenger violates these terms and conditions during the period of use, the Company shall cancel the transportation contract without any notice or warning.

In this case, the Company shall not refund the usage fee already received to the passenger.

2. If the contract of use is cancelled due to clause 1 of this clause and damage is caused to the Company, the passenger shall compensate the Company for the damage.

Clause 5: Non-smoking vehicles of the Company

All of the Company's vehicles are non-smoking vehicles.

If a passenger smokes or is about to smoke in our non-smoking vehicle, the driver may ask the passenger to stop smoking, and may refuse to accept or continue the transportation if the passenger does not comply with this request.

Article 5 Fares and charges

Paragraph 1 The charges and fees collected by our company are based on the approval of the Director of the Regional Transport Bureau at the time of boarding the passenger.

Paragraph 2 Revision of fares and charges

If our company revises the basic fare after accepting transportation based on Article 3 Paragraph 2, the fare shall be based on the fare table applied at the time of reservation, regardless of the previous paragraph.

Article 6 Collection of fares and charges

Paragraph 1 Our company will request payment of fares and charges by any of the following methods.

When using this service, payment by credit guard using the payment terminal installed in the vehicle

When using this service, payment by transfer to a bank account designated by our company on or before the day of using this service

Issuance of an invoice after operation (limited to corporate addresses)

Article 7 Responsibility for passengers

Paragraph 1 If our company injures the life or body of a passenger by operating our vehicle,

we are responsible for compensating for the damages caused by this.

However, this does not apply if we prove that our company and our staff did not neglect to operate the vehicle, that there was no intention or negligence on the part of the passenger or a third party other than our staff, and that the vehicle had no structural defects or functional impairments.

Paragraph 2 In the case of the preceding paragraph, our company's responsibility to passengers begins when the passenger boards the vehicle and ends when the passenger disembarks.

Paragraph 3 When our company temporarily suspends operation or takes other measures to ensure the safety of transportation due to a natural disaster or other cause beyond our control, we are not liable to compensate passengers for damages incurred as a result of this.

Article 8 Passenger Liability

Paragraph 1 If the Company incurs damages due to the passenger's willful or negligent acts or failure to comply with laws and regulations or the provisions of these transportation conditions

, the Company will request compensation for the damages from the passenger.

Paragraph 2 Among the damages to the Company in the preceding paragraph, damages due to breakdowns, vehicle stains, and

damages due to reasons attributable to the passenger, and damages due to the Company being unable to use the vehicle due to odors, as separately stipulated

The Company will calculate the amount of damages based on the basic fee in the tariff and the period of unavailability, and the passenger will pay

Article 3: If the vehicle is damaged or significantly soiled due to the passenger's willful or negligent actions,

The passenger shall bear the full cost of repairs and maintenance.

Article 4: Prohibited acts

Passengers shall comply with applicable laws and regulations.

In addition, passengers shall not engage in the following acts during or after the period of use of this service.

1. Any act that infringes on the legitimate rights of our drivers and other staff or third parties, including ownership rights and copyrights, intellectual property

2. Any act that causes disadvantage or damage to other users, service providers, or third parties

3. Any act that goes against public order and morals

4. Any act that violates laws, regulations, etc.

5. Any profit-making act related to this service without our approval

6. Any act that interferes with the operation of this service

7. Any act that damages or undermines the credibility of this service and our company

8. Any act that registers false information

9. Bringing in illegal drugs

10. Smoking in the vehicle

11. Being so intoxicated that you cannot clearly tell your destination or have difficulty walking without assistance

12. Opening and closing the doors while the vehicle is moving

13. Sticking your face or hands out of the vehicle through the sunroof or windows

14. Any other behavior that the Company deems inappropriate

Article 9 Substitute Vehicle

Paragraph 1 If the Company is unable to provide the service using the vehicle reserved by the passenger due to an accident, theft, or other reason not attributable to the Company, the Company may offer to provide the service using a vehicle other than the one reserved (hereinafter referred to as the substitute vehicle).

Clause 2: If the passenger accepts the request in the previous clause, our company will apply the same terms of use as when the reservation was made,

and provide the service in a substitute vehicle.

Clause 3: The passenger may refuse the request for a substitute vehicle in this clause 1.

Article 10 Disclaimer

Clause 1: If our company is unable to provide the service due to a force majeure event such as a natural disaster,

we will immediately notify the passenger of this and will not be liable for any damages incurred by the passenger.

Clause 2: Due to the structure of the vehicle and the relevant laws and regulations, the environment in which the vehicle can be operated may be limited, so the driving

the route and parking locations will be at the discretion of the driver.

Due to road conditions near the boarding and disembarking points, you may be asked to board and disembark at a location away from the designated boarding and disembarking point.

In such cases, the Company shall not be held responsible for any inconvenience suffered by the user.

Article 3: If the Company determines that its vehicles cannot be operated safely, the Company will suspend the provision of services

and promptly return any fees already received to the passenger, and shall not be held liable for any damages incurred by the passenger at that time.

Article 4: In the following cases, the Company shall not be held liable for any damages incurred to the passenger's baggage.

1. Damage caused by defects inherent to the baggage, such as deterioration

2. Damage caused by excess weight or capacity

3.Items that are fragile, such as musical instruments, sports equipment (golf clubs, surfboards, scuba equipment, bicycles, etc.), ceramics, glass products, etc., or items that are caused by inherent defects or properties

4. Minor damage (scratches, cuts, dents, dirt)

5. Reports made within 7 days of the date of use of this service

Article 11 Use of Personal Information

Paragraph 1 Passengers agree to our company and our company using their personal information for the following purposes

1. To verify and screen the identity of the passenger.

2. To send information such as direct mail to the passenger.

Paragraph 2: Personal information will not be disclosed to a third party unless the passenger consents.

However, the following cases are excluded.

1. When required by law.

2. When necessary to protect the life, body, or property of a person, and it is difficult to obtain the consent of the person.

3. When it is particularly necessary to improve public health or promote the healthy development of children, and it is difficult to obtain the consent of the person.

4. When it is necessary to cooperate with a national institution, local government, or a person commissioned by them to carry out matters prescribed by law, and obtaining the consent of the person may hinder the performance of the said duties.

Article 12: Offsetting

When the Company assumes financial responsibilities to the passenger in accordance with these terms and conditions, the Company may offset such responsibilities at any time against the financial responsibilities that the passenger assumes to the Company.
